AGREEMENT & RELEASE AND WAIVER OF LIABILITY - By submitting this form, you are agreeing to and bound by all of terms and conditions set forth below.
You are participating at your own will and understand that during the retreat, you will practice and receive information and instruction on the Kaiut yoga method, and other health and wellness activities including group hikes, which may result in physical exertion and/or injuries; and you are fully aware of and assume all risks and hazards involved.
TERMS
Physical and Mental Health
I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Retreat. I represent and warrant that I am in good physical health and have no medical conditions that would preclude or prevent me from fully and safely participating in this Retreat and all activities offered therein. I am in both physical and mental good health and able to fully participate. If at any time during the Retreat, my physical and/or emotional health changes making it unsafe for me to continue participating in the Retreat, it is my obligation to immediately inform Jennifer Curnutt and/or Maryline Roux, and to cease participation accordingly. La Vie Yoga, LLC is not responsible for my continued participation should I be unable to safely participate at any time and will be held harmless for any injury sustained by my further participation and/or failure to inform.
Insurance
I have been advised to purchase travel insurance and am either adequately insured for the full duration of the Retreat for injury, death, loss of personal items, or cancellation; or hereby waive my right to do so and will not hold La Vie Yoga LLC responsible for any loss incurred as a result of such waiver.
Release and Waiver of Liability
I release, waive, discharge, hold harmless and agree to indemnify Jennifer Curnutt, Maryline Roux, La Vie Yoga, LLC, The Hoffmann Hotel, and True Nature Healing Arts from all claims, actions, or losses from personal injury, illness, emotional trauma, property damage or loss, wrongful death, as well as punitive damages that I may incur in connection with my participation in the Retreat and any activities I may engage in during the Retreat weekend, whether or not sponsored or recommended by the Retreat, including, but not limited to, La Vie Yoga, LLC, Jennifer Curnutt and/or Maryline Roux.
Cost of Retreat
I understand that the full cost of the Retreat is $3,200 for all programming and accommodations as outlined in the Retreat brochure. I understand that I am responsible for paying the full cost of the Retreat on or before February 1, 2025. I understand that the cost of airfare, gratuities, transportation and optional travel insurance are not included in this cost.
Deposit/Cancellation Policy
I agree to pay and understand that the $500 deposit for the Retreat is non-refundable. If I cancel my participation in the Retreat, and La Vie Yoga, LLC is able to fill my spot from its waitlist, the deposit will be refunded minus a $100 administrative fee. Otherwise, the deposit is non-refundable.
Final payment is due on or before February 1, 2025. If full payment is not made on or before February 1, 2025, and I have not canceled my participation in writing, I forfeit the full deposit and am responsible for payment of the Retreat in its entirety. Should the Retreat be cancelled by the Retreat, all fees including the $500 deposit will be refunded back to me.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any litigation involving the parties to this Agreement will be filed within the State of Colorado.
I have read the above Agreement and Release and Waiver of Liability and fully understand its contents. I have been given the opportunity to seek legal consultation, and voluntarily and on my own accord agree to be bound by the terms and conditions set forth herein.
